In order to standardize the safety supervision and inspection of special equipment, and implement the safety responsibilities of special equipment production, operation, use units and inspection and testing institutions, in accordance with the Special Equipment Safety Law of the People's Republic of China, the Regulations on Safety Supervision of Special Equipment and other laws and administrative regulations, on May 26, 2022, the State Administration of market supervision formulated and promulgated the Measures for Safety Supervision and Inspection of Special Equipment, which will come into force on July 1, 2022.
The Measures for Safety Supervision and Inspection of Special Equipment includes five chapters, including general provisions, supervision and inspection classification, supervision and inspection procedures, legal responsibilities and supplementary provisions, with a total of 40 articles. The key points are as follows:
1. The market supervision department will supervise and inspect the production (including design, manufacturing, installation, transformation and repair), operation and use (including filling, the same below) units and inspection and testing institutions of special equipment.

2. Special equipment safety supervision and inspection includes routine supervision and inspection, special supervision and inspection, post certification supervision and inspection and other supervision and inspection.

3. The routine supervision and inspection adopt the method of "double random and one open", which randomly select the safety supervision and inspection personnel of the inspected unit and special equipment (hereinafter referred to as inspectors), and regularly publish the supervision and inspection results. Those meeting one of the following conditions shall be included in the list of key units:
- Special equipment users in schools, kindergartens, hospitals, stations, passenger terminals, airports, shopping malls, stadiums, exhibition halls, parks, tourist attractions and other public gathering places;
- The special equipment used in the past two years has had accidents and is responsible for the accidents;
- There are many complaints and reports related to the safety of special equipment, and they are true after investigation.

4. In order to prevent regional and systematic risks, ensure safety, or according to the unified deployment of relevant departments, the routine market supervision and management department shall carry out special supervision and inspection on the production, operation and use units, inspection and testing institutions of special equipment in specific areas and fields within a specific time.

5. The market supervision and administration department shall carry out post license supervision and inspection on whether the licensed special equipment production and filling units and inspection and testing institutions continue to maintain license conditions and engage in licensing activities according to law. The post license supervision and inspection shall be organized and implemented by the market supervision and administration department implementing the administrative license or entrusted to the lower-level market supervision and administration department. The post certification supervision and inspection shall adopt the method of "double random and one open", randomly select the inspected units and inspectors, and timely publish the supervision and inspection results. Those meeting one of the following conditions shall be included in the list of key units:
- Those who made a self-declaration and promised to renew their certificates in the previous year;
- The special equipment produced, filled, inspected and tested in the previous year has had an accident and is responsible for the accident, or has been subject to administrative punishment due to the production, filling, inspection and testing of special equipment;
- Being ordered to recall due to the failure to fulfill the voluntary recall obligation due to product defects in the previous year;
- There are many complaints and reports related to the safety of special equipment, and they are true after investigation.

6. In terms of supervision and inspection procedures, the measures for safety supervision and inspection of special equipment stipulates that when the market supervision department carries out supervision and inspection, more than two inspectors shall participate, show valid administrative law enforcement certificates for safety of special equipment, and explain the source, basis, content, requirements, etc. of the inspection task.
The market supervision department may, if necessary, entrust relevant special equipment inspection institutions with the legal personality of public welfare institutions to provide technical support and services for supervision and inspection, or invite relevant professional technicians to participate in supervision and inspection.
The production, operation and use units of special equipment, inspection and testing institutions and their personnel shall actively cooperate with the market supervision department to carry out safety supervision and inspection of special equipment according to law.
