
There are several legislation updates, including “Minimum Wage Standards in Sichuan, Hunan, Chongqing and Fujian Have Been Raised from April 1st”, “Ministry of Emergency Management Issues The 14th Five-Year Plan for Work Safety Related to Hazardous Chemicals”, “Ministry of Ecology and Environment Prints Notice on the Key Work Related to the Management of Enterprise Greenhouse Gas Emission Report in 2022”, etc.
1. Minimum Wage Standards in Sichuan, Hunan, Chongqing and Fujian Have Been Raised from April 1st
After the adjustment, the three levels of monthly minimum wage standards in Sichuan are increased to CNY 2,100, CNY 1,970, CNY 1,870 respectively, while the hourly minimum wage standards for part-time employment in Sichuan are CNY 22, CNY 21 and CNY 20 accordingly. In Hunan Province, the three levels of hourly minimum wage standards are raised to CNY 1,930, CNY 1,740, CNY 1,550, while the hourly minimum wage standards are adjusted to CNY 19, CNY 17 and CNY 15. Chongqing City implements two levels of minimum wage standards. For monthly minimum wage standards, the two levels are adjusted to CNY 2,100 and CNY 2,000 with an increase of CNY 300. For hourly minimum wage standards, they are increased to CNY 21 and CNY 20. Fujian Province still carry out four levels for the updated minimum wage standards, with CNY 2,030, CNY 1,960, CNY 1810 and CNY 1,660 for monthly minimum wage standards, as well as CNY 21, CNY 20.5, CNY 19 and CNY 17.5 for hourly standards.
2. Ministry of Human Resources and Social Security Introduces <Administrative Supervision Measures on Social Insurance Fund>
The new edition of <Administrative Supervision Measures on Social Insurance Fund> has been executed since March 18th, 2022, which clearly specifies the operating mechanism, responsibility scope, authority and procedures, and relevant legal liabilities for administrative supervision of social insurance fund.
3. Beijing Municipal Human Resources and Social Security Bureau Issues <Notice on Further Actions on Protecting the Rights of Working Hours, Rest and Leaves>
According to the Notice, it mainly investigates and overhauls key Industries, key enterprises, and key industrial zones where working overtime is common, focusing on internet enterprises and affiliated enterprises, technology-intensive enterprises with a large proportion of research and development jobs, labor-intensive processing and manufacturing industries, as well as service enterprises. The investigation and overhaul mainly target at the following aspects of enterprises: formulating internal rules on working hours, rest and leaves; adopting special working hour systems; coordinating overtime work and negotiating with trade union and employees; implementing systems of employees’ rest and leaves; providing overtime pay and unused vacation time. Apart from Beijing, other provinces including Shandong, Anhui, Henan, Guangxi, Qinghai, Hunan, Hubei, Jiangxi have also announced investigation and overhaul on overtime work for about two months.
4. Ministry of Emergency Management Issues <The 14th Five-Year Plan for Work Safety Related to Hazardous Chemicals>
The Plan put forwards that a number of system measures and construction projects should be implemented centering on systematic safety risk prevention. To build the security management system of hazardous chemicals, we should focus on the safety production responsibility system, the investment and governance system of potential risks, the safety prevention and control system, the intrinsic safety development system, the training system for employees, and the basic supporting system. Additionally, to place an emphasis on improving intrinsic safety, we should carry out five projects – quality improvement of chemical industrial park safety, safety prevention and control of large oil and gas reservation bases, safety renovation of enterprises, network construction of safety training, as well as industrial internet plus safety production of hazardous chemicals.
5. Ministry of Ecology and Environment Prints <Notice on the Key Work Related to the Management of Enterprise Greenhouse Gas Emission Report in 2022>
The Notice puts forward clear requirements on the verification of annual emission report 2021 for key emission units in the power generation industry, including carrying out verification, informing verification results, handling objections and making the decision of re-verification, filling in the system, as well as submitting written report to Deputy of Climate Change. As for other industries, they should complete emission accounting and emission report compilation of annual greenhouse gas emissions in 2021 by September 30th, 2022. Meanwhile, they should also report greenhouse gas emissions, production situations, supporting materials, and technical service institutions that compile greenhouse gas emission reports via environmental information platform.
6. <Law of the People's Republic of China on Noise Pollution Prevention and Control> will come into force on June 5th
The 32th Session of the Standing Committee of the 13th National People's Congress passed <Law of the People's Republic of China on Noise Pollution Prevention and Control> on December 24th, 2021, which will be put into effect on June 5th, 2022. There are six highlights in the new Noise Pollution Law as follows:
1) Defining the connotation of noise pollution and expanding the scopes of application.
2) Perfecting the noise standard system to control the noise pollution scientifically and accurately in accordance with law.
3) Enhancing noise prevention and controlling at the source to build the first line of defense on noise.
4) Strengthening the government responsibility on noise and specifying objective assessments and evaluations.
5) Developing classified management of noise pollution to implement problem-oriented policies precisely.
6) Focusing on the challenges of noise disturbance to guarantee the peaceful and harmonious environment.
