France Revises Authorized List of Substances for Rubber Food Contact Materials and Pacifiers

France has amended its ‘authorized list of substances subject to dossier submission before July 1, 2025’, reducing the number of entries to ten.

In August 2020, France issued a new Order to regulate food contact rubber materials and articles, as well as pacifiers for young children (SafeGuardS 128/20 and related references). Article 4-II of this law permit the use of substances listed in Annex VIII, under specified conditions, for rubber materials and articles until July 1, 2025. This provision also requires a dossier to be submitted to the Directorate General for Competition, Consumer Affairs and Fraud Control (Direction Générale de la Concurrence, de la Consommation et de la Répression des frauds, DGCCRF) for evaluation before this date.

On August 7, 2025, France’s Ministry of Economics, Finance and Industrial and Digital Sovereignty (Ministère de l'Économie, des Finances et de la Souveraineté industrielle et numérique) issued a notice revising the list of substances in Annex VIII of the new Order. This amendment reduces the number of entries on the ‘List of authorized constituents subject to the submission of the dossier necessary for their evaluation before July 1, 2025’ from 60 to 10.

From July 1, 2025, suppliers that have not submitted an evaluation for the ‘amended’ list of substances in Annex VIII are not permitted to use them, unless they have met the conditions in Article 10 – substances used in the manufacture of rubber materials and articles from other EU Member States, Turkey or a state party to the European Economic Area (EEA) are deemed to comply with the Order when certain conditions are met.

This notice is effective immediately.
