On December 11, 2021, the Ministry of Ecology and Environment of China promulgated the administrative measures for the legal disclosure of enterprise environmental information, and it came into effect on February 8, 2022.
The Administrative Measures for the Legal Disclosure of Enterprise Environmental Information defines the basic contents of the legal disclosure of enterprise environmental information, such as the subject, content, form, time limit, supervision and management, strengthens the main responsibility of enterprise ecological environment protection, and standardizes the legal disclosure of environmental information. The key points of the management measures are as follows:
1. It defines the subjects of environmental information disclosure according to law: focus on enterprises with great environmental impact and high public attention, require key pollutant discharge units, enterprises implementing compulsory cleaner production audit, listed companies in compliance with the provisions, debt issuing enterprises and other subjects to disclose environmental information according to law, and at the same time, make a list of enterprises that disclose environmental information according to law The time limit for enterprises to be included in the list has been stipulated.

2. Clarify the contents of enterprise environmental information disclosure according to law: for the annual environmental information disclosure report according to law, key pollutant discharge units are required to disclose eight types of information, including enterprise environmental management information, pollutant generation, treatment and emission information, carbon emission information, ecological environment emergency related information and ecological environment illegal information; Require enterprises implementing mandatory cleaner production audit to disclose the reasons, implementation, evaluation and acceptance results of mandatory cleaner production audit on the basis of disclosing eight types of information; Listed companies and bond issuing enterprises that meet the specified conditions are required to disclose the response to climate change, ecological and environmental protection and other information of financing projects on the basis of disclosing eight types of information. For the information with high market attention and strong timeliness, such as the change of ecological environment administrative license, administrative punishment and ecological environment damage compensation, enterprises are required to disclose it in time in the form of temporary environmental information disclosure report according to law.

3. It stipulates the construction of the legal disclosure system of enterprise environmental information, information sharing and submission, supervision and inspection and social supervision, defines the violations and corresponding penalties, and takes the legal disclosure of enterprise environmental information as an important content of evaluating enterprise credit.

The Ministry of ecology and environment, together with relevant departments of the central and state organs, will pay close attention to the implementation of the Administrative Measures for the Legal Disclosure of Enterprise Environmental Information, strengthen policy coordination, standardized coordination and work connection, timely summarize experience, publicize and promote it, and guide and urge enterprises to disclose environmental information truthfully, accurately and timely.
