Safety Regulations on Dust Explosion Prevention in Industrial and Trade Enterprises of China effect from Sep.1, 2021

On July 25, 2021, the Emergency Management Department of China promulgated the Safety Regulations on Dust Explosion Prevention in Industrial and Trade Enterprises, and it came into effect on September 1, 2021.

Dust explosion prevention in industry and trade is an important field to prevent and curb major accidents. The formulation of Safety Regulations on Dust Explosion Prevention in Industrial and Trade Enterprises is of great significance to promote industry and trade enterprises to implement the main responsibility for dust explosion safety, standardize and strengthen safety supervision and law enforcement, and prevent and reduce dust explosion accidents. The main points of this provision are as follows:

1. Dust explosion-related enterprises shall take the main responsibility for dust explosion-proof safety, and shall meet the dust explosion-proof safety production conditions specified in relevant laws and regulations, national standards or industrial standards:

Basic management:

It puts forward clear requirements for safety management system, education and training, labor protection articles, emergency rescue plan and drill, risk identification and hidden danger investigation, and "three Simultaneities" of safety facilities.

In case of dust explosion, the enterprise shall organize special safety production education and training for the persons in charge of production, equipment, safety management and dust operation personnel involved in dust explosion prevention. Those who fail to pass the education and training shall not allowed to work.

Risk identification should be carried out for the two main risk factors of dust explosion, dust cloud and ignition source; According to the two key factors of dust explosion characteristics and the number of workers involved in dust explosion, the risk level of dust explosion dangerous places is evaluated; Establish a safety risk list and implement control measures.

In terms of source control, it is required that the design and construction of safety facilities for new reconstruction and expansion projects of enterprises should highlight the relevant contents of dust explosion prevention in accordance with relevant national standards or industrial standards such as dust explosion prevention safety regulations.

On site management:

The technical support requirements for key links are defined, effectively connected with relevant national and industrial standards, and specific provisions are made for the structural layout, safety distance, explosion-proof measures of dust removal system, typical processes, safety equipment, dust cleaning and disposal, maintenance and outsourcing operations of buildings (structures) of dust explosion-related enterprises.

It is specified that safety equipment such as explosion relief, explosion-proof, explosion suppression, inerting, gas locking and ash unloading, impurity removal, monitoring, alarm, spark detection and elimination shall meet the standard requirements and ensure normal operation.

In terms of dust cleaning and disposal, it is clear that the dust operation area should ensure the bottom-line requirements of each shift. For the disposal of aluminum magnesium and other metal dust and magnesium alloy waste, it is required to avoid large accumulation of dust and waste or multi-layer stacking after bagging. If it is really necessary to store temporarily, it shall be away from the operation site and other densely populated places, and necessary fire and explosion-proof measures such as waterproof and moisture-proof, ventilation and hydrogen monitoring shall be taken.

These contents are the key links to prevent dust explosion accidents. Dust explosion related enterprises should pay special attention. At the same time, these requirements are also important contents of special rectification and law enforcement inspection.

2. Dust explosion related enterprises have high safety risks and a large number. The regulatory authorities are facing great pressure and challenges on how to improve the efficiency of supervision and law enforcement and effectively prevent and curb dust explosion accidents. The safety regulations on dust explosion prevention in industrial and trade enterprises put forward the following requirements in terms of supervision and management:

Firstly, key enterprises should be highlighted.

All regions shall, in combination with their actual conditions, include enterprises with high explosion risk and large number of powder related operations such as metal dust, wood dust and agricultural and sideline product processing dust into the key inspection objects and into the annual law enforcement plan.

Secondly, focus on key links.

Law enforcement inspection shall focus on key parts and key links such as dust removal system, fire and explosion prevention, dust cleaning and disposal, and urge enterprises to implement dust explosion-proof control measures in accordance with relevant standards and regulations such as judgment standards for major accident hidden dangers in industry and trade industry and key matters of law enforcement inspection.

Thirdly, we should strengthen technical support.

Safety technical service institutions can be entrusted to provide technical services such as safety evaluation, detection and inspection, hidden danger investigation, etc., and their reports and results can be used as the basis for administrative law enforcement.
