New York State Bans PFAS in Firefighting Personal Protective Equipment

The US state of New York has approved measures to prohibit the use of intentionally added per- and polyfluoroalkyl substances (PFAS) in firefighting personal protective equipment (FPPE). The ban will become effective on January 1, 2028.

Under New York’s General Business Law Section 391-U ‘Restrictions on the sale and use of firefighting equipment containing PFAS chemicals’, a manufacturer or other person selling FPPE must provide written notice to the purchaser at the time of sale if the FPPE contains PFAS chemicals. The notice must include a statement that the FPPE contains PFAS chemicals and an explanation of why they have been used.

On May 9, 2025, the governor of New York signed S3008 (Chapter 58) into law. Part SS of this budget bill amends the aforementioned law by repealing the need to provide a reason for adding PFAS in notices provided to purchasers. Furthermore, it prohibits or restricts PFAS in FPPE.

Highlights of Part SS to S3008 are summarized in Table 1.
