Minnesota, USA, Extends Reporting Deadline for PFAS in Products

Minnesota has delayed the reporting due date for per- and polyfluoroalkyl substances (PFAS) in products by six months.

In 2023, Minnesota approved HF 2310 (Chapter 60, Amara’s Law) to regulate intentionally added PFAS in products. This law prohibits PFAS in 11 product categories starting January 2025, requires a PFAS disclosure program for products on or before January 1, 2026, and establishes an eventual ban on the use of these chemicals in products beginning 2032 (SafeGuardS 101/25 and references therein).

The Minnesota Pollution Control Agency (MPCA) has now announced a six-month extension to the initial reporting deadline from January 1 to July 1, 2026. This extension will give manufacturers, which includes importers or first domestic distributors, as defined by statute, additional time to:

  • Set up agreements with suppliers to report on their behalf as permitted in the proposed rule
  • Become familiar with the PFAS Reporting and Information System of Minnesota (PRISM), a new platform that will be available in late 2025, which includes tools to simplify reporting

The MPCA website has provided a helpful timeline to assist stakeholders with reporting PFAS in products under Amara’s Law (Table 1)
