On July 14, 2025, the EU issued Commission Delegated Regulation (EU) 2025/1399 to revise the entry for perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds under Part A to Annex I of Regulation (EU) 2019/1021 on POPs (POP Recast Regulation, current consolidated version to October 2024).
Key changes include:
- Aligning the nomenclature for perfluorooctanoic sulfonic acid and its derivatives (PFOS) in column 1 with those for PFOS, its salts and PFOS-related compounds
- Pushing back the date by five months for allowing the use of PFOA, its salts and PFOA-related compounds in fire-fighting foam (FFF) for liquid fuel vapor suppression and Class B liquid fuel fires that were already installed in both mobile and fixed systems from July 4, 2025 to December 3, 2025
- Establishing a requirement of ≤ 1 mg/kg for PFOA or any of its salts and, ≤ 10 mg/kg for individual and sum of PFOA-related compounds, as unintentional trace contaminant (UTC) in FFF for liquid fuel vapor suppression and Class B liquid fuel fires from August 3, 2028
- Introducing a requirement of ≤ 10 mg/kg for the sum of PFOA, its salts and PFOA-related compounds as UTC in fluorine-free FFF that originates from the fire-fighting equipment which has undergone cleaning
- Permitting articles containing PFOA, its salts or PFOA-related compounds already in use in the Union to continue to be used beyond their specified time-limited derogations for
- Photolithography or etch processes in semiconductors,
- Photographic coatings applied to films,
- Textiles for oil- and water repellence for workers from dangerous liquids and
- Invasive and implantable medical devices
The amendment will enter into force on August 3, 2025.
